Giving terms
1. Who you are giving to
1.1. DeenWell is a brand of Kyan Oberas, sole proprietor operating as Oberas Co (Ontario BIN 1001234697), referred to here as "we" or "us". When you give to DeenWell, you are giving to that business.
1.2. "DeenWell" is not yet a registered business name in Ontario. To confirm: register "DeenWell" under the Business Names Act before these terms go live, or keep the wording "Oberas Co, for its DeenWell brand" on every payment page.
1.3. "You" means the person giving.
2. We are a business, not a charity
2.1. Oberas Co is not a registered charity, a non-profit organisation or any other kind of qualified donee under the Income Tax Act.
2.2. We cannot issue official donation receipts for income tax purposes, and your gift is not tax-deductible. Any receipt you get from us or a platform is a record of payment only.
2.3. We will never describe a gift as tax-deductible, and we will never say it goes to a registered charity. If you see wording on any of our pages or posts that suggests otherwise, it is an error. Please tell us and we will fix it.
2.4.
3. What your gift pays for
3.1. Your gift pays for making and spreading DeenWell films about the Ahlul Bayt (as). That includes:
- (a) the people who make the films: writers, editors, researchers, contractors, and, under the DeenWell Network, the independent creators whose films we distribute (clause 4);
- (b) the tools used to make them, including AI generation, voice and audio software and computing time;
- (c) getting the films to people: hosting, the website, the tools that send film links to people who ask for them, and promoting the films; and
- (d) the running costs of the business that makes all of this possible.
3.2. How the founder is paid. Kyan Oberas founded DeenWell, makes the films and runs the business. He is paid like anyone else on the team: for the hours he works, at a set rate.
3.3. Campaign gifts. When you give to a specific campaign, such as a LaunchGood campaign with a stated budget, we spend that money on the purposes and budget the campaign page describes, and we keep it separate in our books from our other income (DW-SOP-FIN-003). If we raise more than a campaign needs, the extra goes to the next films. To confirm: the current campaign budget split, see the reviewer note above.
3.4. General gifts. Gifts not tied to a campaign go to the films generally, at our discretion.
3.5. We show the money. We publish a plain account of what gifts paid for and what films they produced. To confirm: how often. deenwell.org promises a quarterly ledger, per the internal notes, and none has been published yet.
3.6. We do not promise a number of films, a release date or a particular film in exchange for a gift. Films come out when they are finished, to the standard, not to a deadline.
4. Gifts and the creators we distribute
4.1. Some DeenWell films are made by independent creators and distributed by us through the DeenWell Network. When a gift comes in through one of those films, part of it is paid to the film's creator.
4.2. The proposed share is half of the gifts that film brings in, after platform fees, paid monthly. To confirm: the creator split is Claude's recommendation and has not been locked by Kyan, per the internal notes, open question 1. Publish the number only once it is locked and the distribution agreement DW-LGL-NET-001 is signed.
4.3. We tell you on the film's page when a film is a Network film.
5. Dedications ("in memory of" and "in honour of")
5.1. You can dedicate a gift, or sponsor a film, in memory of someone who has passed away or in honour of someone living.
5.2. What you get. Depending on the gift level you choose, the dedication appears in the film's end credits, on our supporters' page, or both, as described at the time you give. [BLANK: the dedication levels and what each includes, copied from the live give page at the time of publishing. deenwell.org currently carries a $50 "For the soul of" level, per the internal notes.]
5.3. Wording. You give us the name and the wording. We may shorten it to fit the credits and will check spelling with you if it is unclear. We will not publish wording that is offensive, that names a sacred figure in a way that breaks our religious standards, or that would mislead viewers. If we can't use your wording, we will contact you, and if we can't agree, we will refund the gift.
5.4. Which film. Dedications are placed on the next film to be finished after your gift, in the order gifts arrive, unless the give page lets you choose a film. Each film has a limited number of dedication places. To confirm: the number of dedication slots per film. Twenty was recommended in the internal notes and not decided. Where a level includes dedicating a whole film, there is one such dedication per film.
5.5. Timing. We tell you which film carries your dedication when it is assigned, and send you the link when the film is released. To confirm: the longest a donor can wait before a dedication is placed, after which they may ask for a refund.
5.6. Permanence. Once a film is released with your dedication, we cannot always change the credits. We can always change or remove the supporters' page entry.
5.7. Your responsibility. Only dedicate a gift to someone whose name you have the right to share.
5.8. A dedication is a way of honouring someone. It is not a promise about any religious reward. Whether a gift counts as sadaqah jariya for the person named is between you, them and Allah (swt).
6. Anonymous gifts
6.1. If you give anonymously, or ask us not to publish your name, we won't. A dedication can still be published without your name on it.
7. Monthly gifts
7.1. If you set up a monthly gift, it repeats on the same day each month until you cancel.
7.2. You can cancel at any time, from the link in your receipt or by contacting us. Cancelling stops future gifts. It does not refund past ones.
7.3. To confirm: which platform runs monthly gifts (the Stripe page or LaunchGood), and the cancel route on each.
8. Refunds
8.1. Gifts are generally final, because we start spending them on films.
8.2. We will refund a gift if:
- (a) you gave by mistake, or gave the wrong amount, and tell us within [BLANK: number, recommended 14] days;
- (b) your card was used without your permission;
- (c) we cannot deliver a dedication or credit you paid for (clauses 5.3 and 5.5); or
- (d) the law requires it.
8.3. How to ask: contact us at To confirm: contact email with the date, amount and platform.
8.4. Platform rules come first. A gift through LaunchGood is refunded through LaunchGood under its own refund policy, and a gift through Stripe or Buy Me a Coffee is refunded through that platform. Platform fees may not be returned. To confirm: LaunchGood's and Stripe's refund windows and whether their fees come back on a refund.
8.5.
9. A note on sadaqah
9.1. Many of our donors give as sadaqah. We take that trust seriously, which is why these terms tell you exactly where the money goes, including that it pays the people who make the films and, for Network films, their creators.
9.2. [TO CONFIRM with Kyan's verification route: whether sadaqah given on these terms can pay creator royalties and staff, and whether the page should say anything about khums or zakat. This is a fiqh question, not a legal one. the internal notes records that Kyan has his own verification process, which is not written down, so this is handed to him and not answered here.]
9.3. If you want your gift to go only to a specific purpose, tell us before you give and we will tell you honestly whether we can honour it.
10. Platforms
10.1. LaunchGood. Until DeenWell has its own give page, the main way to give is our LaunchGood campaign. LaunchGood processes the payment, takes its own fees and pays the rest to us. LaunchGood holds back part of the money while a campaign is active. LaunchGood's own terms and privacy policy apply to how it handles your payment.
10.2. Stripe and Buy Me a Coffee. Gifts through our own donation link and through Buy Me a Coffee are processed by Stripe.
10.3. App stores. Gifts are never taken inside the DeenWell app. The app's donate links open in your web browser.
10.4. Our privacy policy (DW-LGL-CO-010) explains what information we receive about you from each platform and what we do with it. Giving does not add you to our email list unless you tick the box to join (DW-LGL-CO-011).
11. Changes
11.1. We may update these terms. The version on the page when you give is the one that applies to your gift.
12. Governing law
12.1. These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
